U.S. Food & Drug Administration Alert: the FDA has analyzed reports of a number of serious birth defects related to the epilepsy drug Topamax including cleft lip, cleft palate, hypospadias and cranial malformations.
New data show that expecting mothers who take the drug are over 20 times more likely to give birth to infants with an oral cleft defect compared to the risk in a background population of untreated women. The defective drug attorneys at Schmidt & Clark, LLP urge mothers who have used Topamax, or its generic topiramate, to contact an attorney as soon as possible if their child was born with congenital birth defects.

Pregnancy Category D
In addition to the new warning, the FDA has also enhanced Topamax to Pregnancy Category D, meaning that topiramate has a proven risk of causing birth defects. The administration is advising women of childbearing age who are taking Topamax to talk with their healthcare professionals about alternative treatment options.
Topamax False Claims Lawsuit
In April 2010, a settlement of over $75,000,000 was reached in a lawsuit filed in 2003 against drug manufacturer Ortho-McNeil-Janssen Pharmaceuticals, Inc. (“OMJPI”). The claim stated that the drugmaker acted improperly in the marketing, promotion and sale of Topamax for a variety of psychiatric conditions other than those for which its use was approved by the FDA (i.e. “off-label” uses).
Topamax Side Effects
In addition to the congenital birth defects mentioned above, Topamax has also been linked to a number of serious side effects in users including suicidal thoughts, acute myopia, secondary angle closure glaucoma, and permanent vision loss.
